Data Act information

CampOne GmbH, Herrliberg, Switzerland, provides the Grondia software as a service to campgrounds. The EU Data Act (Regulation (EU) 2023/2854) requires us to publish the following information. Our General Terms of Service refer to this page.

1. Jurisdiction of our ICT infrastructure (Art. 28(1)(a))

The application servers, the main database, its standby copy and the database backups are located in data centres in Switzerland. Vercel and Cloudflare deliver content through global networks.

CampOne GmbH itself is established in Switzerland and subject to Swiss law.

2. Measures against unlawful international governmental access to non-personal data (Art. 28(1)(b))

We protect non-personal data held in the Union (for example pricing, availability, site plans, aggregated statistics and configuration) against access by or transfer to authorities of third countries where such access would conflict with EU law or the law of the relevant Member State. Our measures:

Technical

  • The main database, its standby copy and its backups are stored in Switzerland.
  • Connections to our services are encrypted in transit (TLS).

Organisational

  • We do not disclose customer data to any government authority unless we are legally required to do so by a binding order that is enforceable against us.
  • We review every request for its legal basis, its compatibility with Swiss law, with EU law and the law of the relevant Member State, and its scope. We challenge requests that are unlawful, overbroad or that conflict with EU or Member State law, using available legal remedies.
  • A request from a foreign authority must in principle be made through international legal or administrative assistance.
  • We disclose only the minimum data required and inform the customer concerned before disclosure, unless the law prohibits this. If we are prohibited from informing, we seek to have the prohibition lifted.
  • We document every request and our response.

Contractual

3. Fees and charges for switching and data export (Art. 29(4) and (6))

Standard service fees. The standard service fees for the Grondia services are agreed in the Order Form. They can include a one-time setup fee, recurring subscription fees, fees for professional services and hardware and, where the customer uses Grondia Pay, a commission under the Payments Addendum. The standard service fees continue to apply until the contract ends. They are not switching charges.

Early termination penalties. If an EU customer ends its contract early by switching under the Data Act, an early termination fee applies only if it is agreed in the Order Form. Where no early termination fee is agreed, none applies. No early termination fee applies where the customer terminates for a reason attributable to Grondia, including termination for good cause. Any early termination fee is the only charge for early exit: Grondia refunds prepaid fees for the period after the contract ends, less that fee.

Switching charges. Grondia charges EU customers no switching charges and no data egress charges for the switching process. For every customer, the export of its data at any time during the contract and reasonable assistance with moving to another provider when the contract ends are free of charge.

Work that goes beyond switching, for example transforming data into the import format of a specific new provider or writing custom migration scripts, is not a switching charge. Grondia offers it separately as a professional service, only at the customer’s written request, at the rates stated in the Order Form.

Complex switching. Grondia is not aware of any part of its services that involves highly complex or costly switching, or for which switching is impossible without significant interference in the data, digital assets or service architecture, other than the known restrictions listed in Schedule 3 of our Exit and Switching Annex.

4. How switching works (summary)

An EU customer can ask at any time, irrespective of the agreed term, to switch to another provider or to its own infrastructure, or to have its exportable data and digital assets erased. Switching then works as follows:

  • Notice period for switching: at most 2 months (Art. 25 Data Act).
  • Transitional period: at most 30 days after the notice period ends. If 30 days are technically unfeasible, Grondia gives the reasons and proposes an alternative transitional period of at most 7 months, during which the services continue.
  • Retrieval period: at least 30 days after the transitional period.
  • Erasure: after the retrieval period, Grondia erases the customer’s exportable data and digital assets within 30 days, and copies in backups age out within a further 90 days. Grondia confirms the erasure in writing.
  • Exportable data and formats: the categories of exportable data are listed in Schedule 1 of our Exit and Switching Annex. Structured data is exported in JSON, lists and reports in CSV, and invoices, receipts and documents in PDF or in their original file format.

The full rules are in our Exit and Switching Annex. Part A applies to every customer. Part B implements the Data Act and applies to EU customers.
