CampOne GmbH, Herrliberg, Switzerland, trading as Grondia (“Grondia”), operates the Grondia software and hosts websites and online booking pages for campgrounds (“customer websites”). For this hosting, the EU Digital Services Act (Regulation (EU) 2022/2065, “DSA”) applies. This page provides the information the DSA requires.

1. Single point of contact for authorities (Art. 11 DSA)

Member State authorities, the European Commission and the European Board for Digital Services can contact Grondia directly and electronically at:

hello@grondia.com

Languages: English and German.

2. Single point of contact for users (Art. 12 DSA)

Users of customer websites, campgrounds and anyone else can contact Grondia about the DSA in a fast, direct and user-friendly way:

A person at Grondia reads every message. We do not rely solely on automated tools. Languages: English and German.

3. Who is responsible for the content of customer websites

Each campground decides what its website and booking pages say and is responsible for that content. Grondia stores and delivers the content for the campground. If you have a concern about content, you can contact the campground directly through the contact details on its website, or report it to Grondia as described below.

4. How to report illegal content (Art. 16 DSA)

If you believe that content on a customer website hosted by Grondia is illegal, report it with our web form or by email to hello@grondia.com. Your notice should contain:

  1. Why the content is illegal: a sufficiently substantiated explanation of the reasons why you consider the information to be illegal content;
  2. Where it is: the exact web address or addresses (URLs) of the content and, where necessary, further information to identify it (for example a description of a screenshot or the text passage);
  3. Who you are: your name and email address (not required if your notice concerns child sexual abuse material or related offences referred to in Articles 3 to 7 of Directive 2011/93/EU);
  4. Good faith statement: a statement that you believe in good faith that the information and allegations in your notice are accurate and complete.

What happens next:

  • If you give us an email address, we confirm receipt by email without undue delay.
  • We review the notice in a timely, diligent, non-arbitrary and objective manner. A person makes the decision; we tell you if we use automated means to process or decide on a notice.
  • We may contact the campground and give it the opportunity to respond, unless that would be inappropriate (for example in case of a risk to life or safety).
  • If you give us an email address, we tell you our decision without undue delay and explain how you can challenge it.
  • If we have reason to believe that content involves a criminal offence threatening someone’s life or safety, we inform the competent law enforcement or judicial authorities (Art. 18 DSA).

5. What we do with content and how we inform the campground (Art. 17 DSA)

If we remove content, disable access to it, restrict its visibility, suspend our services or the campground’s account, or restrict payments to the campground, because the content is illegal or breaches our terms, we give the campground a clear and specific statement of reasons, at the latest when the restriction takes effect. The statement tells the campground what we did and for how long, why, on which legal or contractual ground, whether automated means were used, and how it can challenge the decision.

6. Our terms on content (Art. 14 DSA)

The restrictions that apply to content on customer websites, our procedures and the tools we use are set out in section 12 of our General Terms of Service and in our Acceptable Use Policy. We apply them diligently, objectively and proportionately, with due regard to the rights and legitimate interests of everyone involved, including freedom of expression.

Transparency reports: Grondia is a micro or small enterprise within the meaning of Recommendation 2003/361/EC and provides a hosting service that is not an online platform. It is therefore exempt from the duty to publish transparency reports under Art. 15(1) DSA (Art. 15(2) DSA).

Orders from authorities: we inform the issuing authority without undue delay of the effect given to orders to act against illegal content or to provide information (Art. 9 and 10 DSA), and inform the affected campground as the DSA requires.
